Terms of Service

Welcome to SquawkTrail, a service of Casting Karma LLC (“SquawkTrail,” “we,” “us”). By creating an account or using the service you agree to these terms. Please read them — Section 11 requires most disputes to go to individual arbitration and waives class actions, and you can opt out within 30 days.

1. What SquawkTrail is — and what it is not

SquawkTrail monitors the public FAA Releasable Aircraft Database and tells you when the record for an aircraft you’re watching changes — a new lien or conveyance, an ownership change, or a registration-status or certificate-expiration change.

SquawkTrail reports what is in the FAA public record. It does not verify, guarantee, or vouch for anything. Specifically, SquawkTrail is not a title search, not title insurance, not an escrow or closing service, not a lien search of any registry other than the FAA’s, and not legal, financial, or aviation advice. We never assert that an aircraft’s title is clear — we report what the FAA record shows and when it changes, so you can look further. A SquawkTrail report or alert is a prompt to do your own due diligence, not a substitute for it.

2. We are not affiliated with the FAA or any government agency

SquawkTrail is an independent service. We are not affiliated with, endorsed by, or acting on behalf of the Federal Aviation Administration or the U.S. government. “FAA” and aircraft data are referenced solely to describe the public record we monitor.

3. Your account

You must be at least 18 years old, provide accurate information, and keep your login secure. You’re responsible for activity under your account.

4. The data, and its limits

Our information comes from the FAA’s daily public file and the recorded-document index. Two honest limits you agree to accept:

5. Acceptable use — including the one rule that matters most

Don’t misuse the service: no scraping or bulk extraction, no attempts to break or overload the platform, no reselling or redistributing the data as a competing dataset, and no reverse-engineering.

And this one, which is a condition of your access:

You will not use SquawkTrail, or any information from it, as a factor in deciding a person’s eligibility for credit, insurance, employment, housing, or any other purpose covered by the Fair Credit Reporting Act (FCRA). SquawkTrail is a tool for monitoring the status of an aircraft’s public record. It is not a consumer report and we are not a consumer reporting agency. You also agree not to use SquawkTrail to harass, stalk, or intimidate any aircraft owner or to compile profiles of individuals.

6. Aircraft owner privacy

Where the FAA publishes an aircraft’s registered-owner information, we may show it to signed-in subscribers. Where an owner has asked the FAA to withhold their personal information, we honor that — we display only what is in the current public file, we mark withheld records accordingly, and we do not resurface owner information the FAA has since suppressed. We do not display owner street addresses, and we are a service for watching aircraft, not a people-finder.

7. Plans, billing, trial, and refunds

Free lookups. Looking up an aircraft’s current public record is free.

Paid plans (monitoring). Watching aircraft for changes is a paid subscription — Owner, Broker, and Lender/Enterprise tiers, at the prices shown at checkout.

7-day free trial. Paid plans start with a 7-day free trial. A card is required, and we do not charge until the trial ends. You can cancel anytime during the trial and you won’t be charged.

Renewal and cancellation. After the trial, plans bill in advance and renew automatically until you cancel. You can cancel anytime from your account; cancellation takes effect at the end of the period you’ve already paid for, and you keep access until then. We’ll tell you before any price change takes effect. Taxes may apply.

Refunds. Subscription fees already paid are non-refundable except where required by law — but you can always cancel to avoid the next renewal, and the free trial exists so you can evaluate before paying.

If a payment fails. If a renewal fails, we keep your access active while your card issuer and our payment processor retry (typically up to about three weeks). If it ultimately doesn’t clear, the subscription ends and your account returns to free lookups. We do not delete your watchlist — it’s retained and reactivates if you resubscribe.

8. Your content

The aircraft you choose to watch (your watchlist) and your account settings are yours. You grant us the limited rights needed to operate the service for you — chiefly, to check the FAA record for the tails you watch and to send you the alerts you’ve asked for. You can edit or delete your watchlist and export or delete your account at any time.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY RECORD, ALERT, LIEN INDICATION, OR OWNERSHIP DETAIL IS ACCURATE, COMPLETE, CURRENT, OR TIMELY. YOU WILL NOT RELY ON SQUAWKTRAIL AS THE SOLE BASIS FOR BUYING, SELLING, FINANCING, OR INSURING AN AIRCRAFT — THOSE DECISIONS REQUIRE A PROPER TITLE SEARCH, ESCROW, AND YOUR OWN PROFESSIONAL ADVISORS. Decisions you make about an aircraft are yours.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CASTING KARMA LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS OR LOSS ARISING FROM AN AIRCRAFT TRANSACTION, A MISSED OR DELAYED ALERT, OR RELIANCE ON THE FAA RECORD, EVEN IF WE’VE BEEN ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Nothing here excludes or limits liability that cannot be excluded under applicable law, including for fraud or for death or personal injury caused by negligence. Some jurisdictions don’t allow certain exclusions, so parts of this section may not apply to you.

11. Dispute resolution — arbitration and class-action waiver

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO A JURY TRIAL.

Let’s talk first. Email legal@squawktrail.com and give us 30 days to resolve it.

Individual arbitration. If we can’t, you and Casting Karma LLC agree that any dispute arising out of or relating to SquawkTrail or these terms will be resolved by final, binding, individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Texas — or, at your election, by phone/video or in your home county where the AAA rules allow.

Class-action waiver. You and we each waive any right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may award relief only to you individually.

Carve-outs. Either party may bring an individual claim in small-claims court, and either party may seek an injunction to protect intellectual property or stop unauthorized access.

🚪 Your 30-day opt-out. You can opt out of this Section 11 by emailing legal@squawktrail.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these terms. Include your account email. It costs nothing and changes nothing else. If you opt out, Section 12 governs.

12. Governing law and venue

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws rules. For any dispute not subject to arbitration (including if you opt out), you and we consent to the exclusive jurisdiction of the state and federal courts located in Texas.

13. Changes and termination

We may update the service and these terms. If we make a material change, we’ll post it here with a new version and date and ask you to accept it the next time you sign in. You may stop using SquawkTrail anytime. We may suspend or terminate accounts that violate these terms, and we may suspend paid features for non-payment as described in Section 7.
